Introduction

As we attach great importance to the protection of your data and your privacy, we have drawn up this privacy policy, which explains what we do in this regard when you browse our website www.a-track.ch.

This privacy policy covers only the processing of data relating to our website. Specific privacy policies may apply to other services that we may offer.

If you reside in the European Union or the European Economic Area, the General Data Protection Regulation (GDPR) may also apply to our processing, in particular where we offer you goods or services or monitor your behaviour within the EU/EEA. Where applicable, we ensure that our practices also comply with the requirements of the GDPR, in addition to those of the FADP.

In Switzerland, the protection of your data is based in particular on the Federal Act of 25 September 2020 on Data Protection (FADP), as well as on the Ordinance of 31 August 2022 on Data Protection (Data Protection Ordinance, DPO). Our privacy policy and our practices are aligned with the legal provisions contained in the aforementioned legislation.

Although we make every effort to keep our privacy policy simple, the specific language of the legal framework can make it difficult to understand. We have therefore taken the initiative of grouping the main definitions together here, taken from the FADP, in order to make our privacy policy easier to understand.

  • Data subject: the natural person whose personal data is processed.

  • Personal data: any information relating to an identified or identifiable natural person.

  • Sensitive personal data: data relating to religious, ideological, political or trade union-related views or activities; data relating to health, the private sphere or affiliation to a race or ethnicity; genetic data; biometric data that uniquely identifies a natural person; data relating to administrative and criminal proceedings or sanctions; data relating to social assistance measures.

  • Processing: any handling of personal data, irrespective of the means and procedures used, in particular the collection, storage, keeping, use, modification, disclosure, archiving, deletion or destruction of data.

  • Controller: the private person or federal body that, alone or jointly with others, determines the purpose and the means of processing personal data.

  • Processor: the private person or federal body that processes personal data on behalf of the controller.

  • Federal Data Protection and Information Commissioner (FDPIC): the authority responsible for supervising the proper application of federal data protection provisions, in particular the FADP.

Finally, we use the term ‘data’ interchangeably with ‘personal data’.

What is our role in data protection?

When you browse our website, we may process some of your personal data. In accordance with the FADP and the GDPR, we are the controller.

Our role

As the controller, we are responsible for determining the reasons why we process your personal data, how it is processed and the security measures applied. When we work with service providers in the course of our activities, we ensure that they share our commitment to data protection and comply with the same standards that we apply.

Your role

Data protection is everyone’s business. We therefore encourage you to read our privacy policy.

If you are one of our customers, we also encourage you to consult the contractual documents between us, as these may contain further details on how we process your data.

Finally, if you provide us with personal data about other people, such as members of your family, we assume that you have been authorised to do so beforehand and that the data is accurate.

When and how do we collect your data?

As soon as you interact with our website for the first time, we collect data (e.g. to find out whether or not you consent to cookies being placed). When you arrive on our website from one of our advertisements, we also collect click identifiers and campaign parameters (see the section ‘Which cookies do we use?’). You also provide us with your data when you contact us (e.g. via our contact form).

What categories of data do we process?

Depending on how you use our website, we may process the following categories of data about you:

Contact data

We process your contact data, for example your surname, first name, company name, telephone number or email address.

Internet and connection data

For technical reasons and in order to improve our website, each use of it generates certain data, in particular your IP address, information about your internet service provider and your device’s operating system, information about the referring URL, information about the browser used, the date and time of access and the content viewed during your visit to the website.

What about sensitive data?

We do not collect or process any sensitive personal data.

What about data relating to minors?

Although our website is accessible to everyone, our services are intended exclusively for adults. We do not target minors and we do not knowingly collect any personal data about them.

Why do we process your data?

We process your data for the purpose of communicating with you, in particular to respond to your requests and to the exercise of your rights, and to inform you about our services. We also process your personal data in order to generate visitor statistics that help us improve our website, and to measure the effectiveness and profitability of our communication and advertising campaigns. Finally, we process your personal data in order to comply with the laws, directives and recommendations of the authorities.

Do we make automated individual decisions?

In the course of our activities, we use various IT tools to manage them. These tools are designed to centralise and structure processes, improve their efficiency and ensure the quality of our services. It is important to note that we do not make any automated individual decisions using these IT tools.

What are your rights?

Your rights vary depending on the specific circumstances and may be subject to exceptions. In general, the FADP provides for the following.

  • You have the right to access your data.

  • You have the right to request that your data be handed over or transmitted in a commonly used electronic format.

  • You have the right to have inaccurate data rectified.

  • You have the right to object to the processing of your data.

  • You have the right to request the deletion or destruction of your data.

In addition to the FADP, the GDPR provides for the following rights.

  • You have the right to be forgotten, in particular where your data has been made public.

  • You have the right to request the restriction of the processing of your data.

If you wish to exercise the above rights with us, you can contact us. In order to prevent any misuse, we must first identify you (e.g. by means of a copy of your identity card, if no other means of identification is possible). Please note that conditions, exceptions and restrictions may apply to the exercise of these rights in accordance with the FADP and the GDPR (e.g. to protect third parties or trade secrets). Where applicable, we will inform you accordingly.

If you believe that we are processing your data in breach of data protection provisions, you also have the option of reporting us to the FDPIC. We encourage you to inform us first so that we have the opportunity to address your concerns. If we are unable to do so, you can contact the FDPIC by following the instructions given on its website. If you reside in the European Union, you may lodge a complaint with the competent supervisory authority in your country of residence.

How do we secure your data?

We take appropriate security measures, such as encryption, to ensure the security of your personal data and to guarantee its confidentiality, integrity, availability and traceability. Unfortunately, data security can never be fully guaranteed. If you believe that your personal data has been compromised, please contact us immediately.

Where is your data stored?

The personal data that we collect and process is stored on our premises and in the data centres operated by our service providers.

How long do we keep your data?

We process your personal data for as long as the purpose of the processing requires, for as long as we have a legitimate interest in retaining it (e.g. to assert our rights, for archiving purposes or to ensure IT security) and for as long as the data is subject to a statutory retention obligation. For certain data, for example, the retention period is ten years in accordance with the obligation to retain accounting records. Once these periods have expired, we destroy your personal data.

Who do we disclose your data to?

Managing our website involves working with specialised external service providers, in particular for its creation, maintenance and hosting. We work with service providers that are recognised in their field of expertise to ensure that our website functions properly and, more generally, to ensure the quality of our services. In the context of these collaborations, it may be necessary to disclose your data to our service providers. Rest assured that such disclosures are strictly limited to what is necessary and are carried out in compliance with the legal framework.

Where personal data is disclosed to a service provider located outside Switzerland or the European Economic Area (EEA) that does not offer an adequate level of protection, we require the service provider to undertake to comply with the applicable data protection legislation (for this purpose, we use the European Commission’s revised standard contractual clauses), unless the service provider is already subject to a legally recognised set of rules designed to ensure data protection (Swiss-US Data Privacy Framework) or we can rely on an exception.

Our service providers

Some of these service providers operate directly in your browser, while others (in particular Google Analytics, Google Ads and LinkedIn) do not load any script there: they receive the data as recipients via our server-side measurement container, described in the section ‘Which cookies do we use?’.

Which cookies do we use?

Our website uses cookies and similar technologies. For each service, you can view the list of cookies by clicking on ‘Cookie settings’ in our cookie banner.

On your first visit, our consent banner allows you to accept or refuse measurement and advertising tools. These tools, whether loaded in your browser or activated via our server-side measurement container, are only triggered after you have given your consent. Before that, the only processing that takes place is that which is technically necessary for the website to function, together with the audience and attribution measurement described below, to which you may object at any time.

Which scripts does our website load?

On the browser side, our website directly loads only the scripts necessary for it to function (display, security, structured data) and our tag manager. It is through this tag manager that our consent banner and our two in-house measurement scripts described below are then loaded, as well as, depending on your consent choices, our audience measurement tools and, where applicable, advertising tags. Google Analytics, Google Ads, Meta and LinkedIn, for their part, receive the data as recipients via our server-side measurement container, without loading any script in your browser.

Audience and attribution measurement before consent

Before you give your consent, our audience measurement tool (Google Analytics, via Google Consent Mode) may receive technical signals without cookies or identifiers, which only allow aggregated and anonymous traffic statistics. In addition, when you arrive on our website from an advertisement, our first in-house measurement script collects only the click identifier generated by the advertising platform and the campaign parameters used to classify the source of the traffic. This information is stored in our website’s own cookies (for 1 to 12 months depending on the identifier) and passes through our server-side measurement container, together with the status of your consent. These identifiers do not allow us to identify you and we only use them in the form of aggregated statistics. When returned to the advertising platform concerned, however, they enable that platform to attribute to our campaigns the events we measure (e.g. submission of a contact form or a purchase, with the transaction value in CHF), in order to measure their profitability. This measurement is based on our legitimate interest in knowing where our visitors come from and how profitable our campaigns are. You may object to it at any time via ‘Cookie settings’ in our banner.

Data transmitted after consent

After you have given your consent, our second in-house measurement script collects the information that you voluntarily enter in our forms, questionnaires or orders (e.g. email address or telephone number). Before any transmission to our measurement and advertising partners, your contact details are pseudonymised by means of hashing. They are therefore never transmitted to them in plain text, but these platforms may match them against their own user databases for the purpose of measuring conversions.

Detailed list of cookies

The detailed and up-to-date list of cookies used on our website can be found below.

How can I block cookies?

You can block cookies by activating a setting in your browser that allows you to refuse the installation of cookies. You can also use our cookie banner to manage your preferences. If you use your browser settings to disable, reject or block cookies, some parts of our website may not function properly. In some cases, our website may not be accessible at all. Please note that where third parties use cookies, we have no control over how those third parties use them.

What about social networks?

We operate our own presences on social networks and other platforms (e.g. LinkedIn, Facebook, Instagram). When you communicate with us on these sites or comment on or share content there, we collect data that we use primarily to communicate with you. For more information about the processing carried out by the platform operators, please consult their respective privacy policies. There you will also find information about the countries in which they process your data, your rights of access and deletion and other rights of data subjects, as well as how you can exercise these rights or obtain further information.
